{"id":2954,"date":"2023-03-24T06:08:30","date_gmt":"2023-03-24T06:08:30","guid":{"rendered":"https:\/\/www.theukrules.co.uk\/?page_id=2954"},"modified":"2023-09-26T10:47:07","modified_gmt":"2023-09-26T10:47:07","slug":"points-based-system","status":"publish","type":"page","link":"https:\/\/www.theukrules.co.uk\/rules\/immigration\/points-based-system\/","title":{"rendered":"UK Point Based Immigration System | Guide for Visa Applicants"},"content":{"rendered":"<h2>How the New Immigration System Works<\/h2>\n<p>In simple terms, the system applies the same eligibility criteria for EU and non-EU citizens when applying for Skilled Worker visas.<\/p>\n<p>The point based immigration system contains a set of requirements for noncitizens who will be <a href=\"\/rules\/immigration\/arriving\/entering-the-uk\/\">entering the United Kingdom<\/a> for work.<\/p>\n<p>Hence, if you are <a href=\"\/rules\/employment\/employing\/\">planning on hiring people<\/a> from overseas (excluding Irish citizens), you will need advanced permission to do so.<\/p>\n<p><strong>Note<\/strong>: The Home Office global points-based immigration method means <a href=\"\n\/rules\/immigration\/visa\/\">post-Brexit visa applications<\/a> for skilled jobs will need to secure enough points.<\/p>\n<p><\/p>\n<hr>\n<p><\/p>\n<h2>How Many Points are Required?<\/h2>\n<p>The Skilled Worker visa has already replaced the Tier 2 (General) work visa. Starting from the 1st of December 2020, you will gain points for your application if you already have:<\/p>\n<ul>\n<li>An offer of a job from an approved sponsor.<\/li>\n<li>Special skills (e.g. in a shortage occupation as designated by the Migration Advisory Committee).<\/li>\n<li>An appropriate level of proficiency at speaking English.<\/li>\n<\/ul>\n<p>The government wants to attract the brightest minds and the best workers to come and secure employment in the United Kingdom. Hence, the <a href=\"\/rules\/immigration\/\">new immigration rules<\/a> should help employers focus on training and investing in a productive workforce.<\/p>\n<div class=\"content-inner-block\">\n<p><strong>Important<\/strong>: Some <a href=\"https:\/\/www.gov.uk\/coronavirus-health-worker-visa-extension\" target=\"_blank\" rel=\"noreferrer noopener\">free visa extensions<\/a> apply for health workers during the coronavirus (COVID-19) pandemic in the United Kingdom.<\/p>\n<\/div>\n<p><\/p>\n<hr>\n<p><\/p>\n<h3>Characteristics (some tradeable) and points:<\/h3>\n<p><\/p>\n<ul>\n<li>Job offer by approved sponsor: 20<\/li>\n<li>Job at appropriate skill level: 20<\/li>\n<li>Speaks English at required level: 10<\/li>\n<li>Salary between \u00a320,480 (minimum) and \u00a323,039: 0<\/li>\n<li>Salary between \u00a323,040 and \u00a325,599: 10<\/li>\n<li>Salary of \u00a325,600 (and over): 20<\/li>\n<li>Job in a shortage occupation (designated by the MAC): 20<\/li>\n<li>Education qualification: PhD in subject relevant to the job: 10<\/li>\n<li>Education qualification: PhD in a STEM subject relevant to the job: 20<\/li>\n<\/ul>\n<p><strong>Note<\/strong>: Job applicants from overseas countries (e.g. those without relevant <a href=\"\/rules\/legal\/citizenship\/\">citizenship<\/a>) need a total of seventy (70) points to qualify for working in the United Kingdom.<\/p>\n<p><\/p>\n<hr>\n<p><\/p>\n<h3>Brexit: Ending Free Movement<\/h3>\n<p>The Home Secretary reiterated some of the aims of the <a href=\"\/news\/homes-and-lifestyle\/eu-referendum-question\/\">EU referendum result in 2016<\/a> and Brexit that followed. It was to end free movement and to take back control of the borders. Thus, the introduction of a new points-based immigration system should achieve those results.<\/p>\n<p>Having a simplified and flexible system should also help ensure that employers are able to:<\/p>\n<ul>\n<li><a href=\"\/rules\/employment\/employing\/recruiting\/\">Recruit a skilled workforce<\/a>.<\/li>\n<li>Train and invest in personnel for the benefit of the country.<\/li>\n<\/ul>\n<p>Furthermore, easier routes will open up for workers with an exceptional talent or for those who show exceptional promise (e.g. in the fields of science, tech, culture, and engineering, science).<\/p>\n<p>Because applicants will be applying online, it will be necessary to provide some proof of identity along with some relevant documentation.<\/p>\n<p>It should take no more than three weeks to get a decision from the Home Office. A successful application means the visa will last for a period of up to five (5) years before it needs extending.<\/p>\n<div class=\"content-inner-block\">\n<p><strong>Important<\/strong>: After paying the application fee (from \u00a3610 to \u00a31,408), you will also need to <a href=\"\/rules\/immigration\/arriving\/healthcare\/\">pay for the healthcare surcharge<\/a> and have enough funds to support yourself.<\/p>\n<\/div>\n<p><\/p>\n<hr>\n<p><\/p>\n<h2>Other Routes Opening in the United Kingdom<\/h2>\n<p>Starting in December 2020, the Home Office also announced the introduction of several other routes, including the:<\/p>\n<ul>\n<li>Global Talent visa:\n<ul>\n<li>For people with exceptional talent or exceptional promise in the fields of science, medicine, humanities, arts, culture, engineering, or digital technology.<\/li>\n<\/ul>\n<\/li>\n<li>Innovator visa:\n<ul>\n<li>For people who are seeking to establish a UK-based business around innovative, viable, and scalable business ideas.<\/li>\n<\/ul>\n<\/li>\n<li>Intra-company Transfer visa:\n<ul>\n<li>For established workers transferred to the UK so that they can carry out a skilled role.<\/li>\n<\/ul>\n<\/li>\n<li>Start-up visa:\n<ul>\n<li>For people who are seeking to establish a first-time business in the United Kingdom.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Since the 5th of October 2020, eligible international students from around the world have been seeking positions through the Student route and Child Student route.<\/p>\n<p><\/p>\n<hr>\n<p><\/p>\n<h2>How Long Does it Take?<\/h2>\n<p>The date listed on your certificate of sponsorship will show the due date for you to start work.
