Claiming for Health Conditions and Diseases

You may qualify to make a claim through the courts. In some cases you might also claim compensation through Industrial Injuries Disablement Benefit (IIDB).

You could choose to get legal advice and make a claim through the courts system in the United Kingdom for:

• Hearing impairment called Noise Induced Hearing Loss (NIHL).
• Respiratory conditions such as Chronic Obstructive Pulmonary Disease.
• Hand and arm vibration related conditions (e.g. Vibration White Finger).
• Asbestos related conditions such as diffuse mesothelioma.

There is compensation available through a diffuse mesothelioma payment. The claim applies even if you cannot determine the employer (or their insurer) who was responsible for your contact with asbestos.

Coal Workers Pneumoconiosis Scheme

Do you have pneumoconiosis illness and if so, was it caused by coal mining? Employees of British Coal and the National Coal Board affected by pneumoconiosis may be eligible to claim compensation.

Coal miners compensation claims get handled by the Coal Industry Pneumoconiosis Compensation Scheme (CIPCS). The CIPCS uses the same process as the Coal Workers’ Pneumoconiosis Scheme (CWPS).

Coal Health Compensation Eligibility

There is an eligibility criteria to claim through the Coal Health Compensation scheme. You must be receiving Industrial Injuries Disablement Benefit for at least one of these health conditions:

• Pneumoconiosis (includes asbestos, ‘black lung’, and silicosis
• Diffuse bilateral pleural thickening
• Lung cancer (primary carcinoma) with diffuse bilateral pleural thickening
• Lung cancer (primary carcinoma) with asbestosis

To qualify, you must also have worked for at least ten (10) years in coal mining, as a contractor or employee for either the:

• National Coal Board (NCB).
• British Coal Corporation (BCC).

Note: Making a claim under this scheme means you cannot make a claim through the courts as well. Seek legal advice to help you decide which claims method would be better for your case.

Claiming for a Miner who has Died

You can also make Coal Health Compensation claims if your deceased spouse or family member would have been eligible. But, the cause of death as stated on the miner’s death certificate must be one of the qualifying health conditions.

Note: Contact your local Jobcentre Plus if they were not receiving IIDB when they passed away. In some cases you may still make a claim through the Coal Health Compensation scheme.
